1. Terms and Conditions

Effective Date

These Terms and Conditions of Use come into effect the moment you click “Agree” in the FusionMF/Platform.

Confidentiality

a. You acknowledge that all information accessed via Fusion App or any future applications developed by Fusion Mutual Fund (“Fusion MF”) is confidential information (“Confidential Information”). You agree to take reasonable care to prevent unauthorized access during and after usage, until such information enters the public domain.

b. Exceptions: The confidentiality obligation does not apply if the information (i) was already known to you, (ii) becomes public without breach, (iii) is received lawfully from a third party, (iv) is independently developed without reference to Fusion MF’s confidential info, (v) is approved in writing by Fusion MF, or (vi) is disclosed by court or regulatory order with reasonable notice to Fusion MF.

c. Data accessed should only be used for authorized purposes and must be purged after use.

Security Protocols

a. Your devices and network must have adequate firewalls, antivirus, intrusion detection, and access controls. Additional security features are recommended.

b. Any cyber incidents such as unauthorized access must be immediately reported to Fusion MF.

c. Fusion MF may, at its discretion, terminate access in case of a security risk, with or without notice.

d. Intellectual Property Rights in Fusion App, its software, manuals, databases, screens, source/object code, reports, and other content remain with Fusion MF. Users agree to keep them confidential and not attempt reverse engineering or duplication.

e. Illegal use of Fusion App or Fusion MF data may result in immediate termination and liability for losses incurred.

f. Access to Fusion App is subject to applicable regulatory directions; Fusion MF is not liable for indirect consequences.

g. Users and authorized representatives must use Fusion App in compliance with these T&Cs.

Disclaimer

a. Contents of Fusion App are owned by Fusion MF and may not be copied without permission.

b. Fusion MF is not responsible for third-party sites linked from Fusion App.

c. Fusion MF will use reasonable security measures but is not liable for unauthorized access, intercepted emails, or temporary unavailability.

d. No investment decisions should be made solely from Fusion App; use official statements or documents.

e. Services provided are subject to instructions from Fusion MF clients; Fusion MF may alter, suspend, or withdraw services with notice.

f. Certain services depend on secure connections; Fusion MF may suspend services if security is compromised.

g. Transaction acknowledgments on Fusion App are for reference; Fusion MF records are final and binding.

h. Fusion MF reserves the right to charge fees for services at any time.

i. Fusion App does not provide investment advice. Transactions must be through registered distributors after reading scheme documents.

j. Do not use the services if you disagree with these T&Cs.

a. Links to Fusion App must point to https://www.fusionmf.com or approved pages.

b. Linking to specific pages requires prior written approval.

c. Fusion MF is not obliged to reciprocate links and is not responsible for third-party websites.

d. Inclusion of links does not imply endorsement; Fusion MF is not liable for any losses incurred via linked sites.

2. Cookie and Privacy Policy

Cookies

a. Fusion App uses cookies to improve user experience and security.

b. Analytics cookies help improve website/app usability.

c. Third-party websites may have separate privacy policies; Fusion MF is not responsible for them.

Personal Information

Data collected may include name, contact info, bank details, PAN, Aadhar, etc., used to:

Indemnity

Confidentiality, indemnity, and intellectual property clauses survive after you stop using Fusion App.

3. Fusion MF Application’s Terms and Conditions

General

By installing Fusion App, you agree to these terms.

Definition

“Fusion App” is the software provided by Fusion Mutual Fund for mutual fund investment transactions, accessible on iOS, Android, and other devices.

Collection & Use of Data

Fusion App collects user information for transaction processing, personalization, analytics, customer service, and communication.

Consent

Users must provide affirmative consent in the app to allow data collection and use.

Privacy Shield

Fusion App does not intend to use personal data from EU/Switzerland users, but the app may be used by them.

Malicious Behavior

Prohibited: malware, spyware, apps stealing credentials, unauthorized code execution, or apps exploiting vulnerabilities.

4. Proprietary Rights & License

• • All IP in Fusion MF App and its code belongs to Fusion MF or its licensors.

Eligibility

Resident Indian individuals, KYC-compliant, existing mutual fund investors with email registered, may register for Fusion MF App.

System Requirements

Compatible devices and internet connection are required; Fusion MF supports iOS, Android, Windows on a best-effort basis.

Registration & Access

• • • • Transactions require registration via the email in the fund folio.
      • Fusion MF may add or remove services at its discretion.
      • Users must not share login credentials or attempt unauthorized access.
      • All transactions through login credentials are deemed authorized by the user.

Usage by Minors

Only guardians of minors may use Fusion MF App for transactions.

Liability & Indemnity

• • • • Users accept responsibility for transactions and compliance with mutual fund rules.
      • Fusion MF is not liable for third-party or network failures.
      • Users must safeguard passwords; Fusion MF is not liable for unauthorized access.

NAV & Cutoff
Transactions are processed per scheme NAV and cut-off timings in the official SID

5. Termination & Governing Law

• • • Fusion MF may terminate user access at its discretion.
    • Users may request termination with 15 days prior notice.
    • Users remain responsible for transactions until termination
    • Governing Law: Laws of India; courts in Mumbai have jurisdiction.

6. Confidentiality, Security & Password Management

• • • All access to Fusion MF App data is confidential and must follow security protocols
    • Security includes firewalls, antivirus, access control, and virus detection.
    • Cyber incidents must be reported immediately.
    • IP and technical details of Fusion MF App must be kept confidential.
    • Unauthorized access or illegal usage may result in termination and indemnity obligations.

Password Policy

Do’s:

• • • Password 8–15 characters, mix of cases, numbers, special chars (#_$@)
    • Change temporary password at first login
    • Change password every 90–365 days
    • Access only via official Fusion App

Don’ts:

• • • Avoid dictionary words, personal names, simple patterns
    • Don’t store unencrypted passwords or share with others
    • Do not use auto-complete on untrusted devices
